And here’s the kicker — there’s no comprehensive federal AI law. The White House directed the Secretary of Commerce to evaluate “burdensome state AI laws” by March 2026, but that evaluation is just a report, not relief. Until Congress acts, you’re navigating a patchwork where different states have different definitions, different standards, and different mandates.

A2A (Agent-to-Agent Protocol) handles agent-to-agent communication. Google built it, Linux Foundation governs it, 50+ technology partners on board. Agents discover each other, delegate tasks, coordinate workflows.

Together, MCP + A2A form a clean architecture. A2A for the network layer, MCP for the resource layer. It makes sense. And it has the same problem HTTP and FTP had in 1995, right before we discovered all the ways they could be abused together.

The Identity Gap in Three Sentences

MCP has its own auth model (OAuth 2.1, still messy in practice). A2A has its own auth scheme. There’s no unified identity that flows across both layers. A2A’s AgentCard — the closest thing to agent identity — is self-reported and unsigned. An agent can basically say “trust me, I’m authorized” with zero cryptographic proof.

Teams that care about this (and most don’t yet) are handling it manually: pass a signed token through each layer transition, from user authentication to orchestrator to specialist agent to MCP server. It works. It’s fragile. It’s the kind of thing that looks fine in a demo and collapses in production under regulatory scrutiny.

The A2A Secure Passport Extension, announced late 2025, is a step toward fixing this — but it’s not widely implemented. The W3C AI Agent Protocol Community Group is working on official web standards with decentralized identity (W3C DID) and end-to-end encryption, but specifications aren’t expected until 2026-2027.

Translation: The plumbing that agents use to talk to each other and to tools has no built-in answer to the question regulators are about to require every enterprise to answer: which agent acted, with what authority, and can you prove it?

Most observability tools handle the LLM reasoning layer but miss the actual execution and side effects. A thorough audit trail requires capturing data at five distinct layers — and the gap between Reasoning and Action is where most teams lose the thread.

The most common gap is between Reasoning and Action. An agent may log its chain-of-thought but fail to record the actual API call it made — making it impossible to verify that the action matched the intent. That gap is exactly what auditors will probe, and it’s exactly where the builder opportunity lives.


If your agent signs a bad contract, are you bound by it?

AI agents aren’t just reading data and generating text anymore. They’re executing code, moving money, and in some cases negotiating and signing contracts.

Traditional agency law — the framework for “when one party acts on behalf of another” — was written for humans. Courts are now facing questions it was never designed to handle: If an AI agent executes a disadvantageous contract, is the user bound by it? If an agent provides bad medical advice and someone is harmed, who’s liable — the user, the developer, or the platform?

As of February 2026, courts have not issued definitive rulings allocating liability for fully autonomous agent behavior. That’s both terrifying and revealing. The legal framework is being written right now, in real time, through enforcement actions, case law, and procurement requirements.

What’s emerging is a clear pattern: whoever can demonstrate accountability wins. If you can show an immutable audit trail — which agent acted, what triggered the action, what decision logic was applied, what the outcome was — you’re in a defensible position. If you can’t, you’re exposed.
